I have a Living Trust – can it be amended?

If you have a living trust in place, it can probably be amended. It is, however, completely dependent on whether it is what is known as a Revocable Trust.

The majority of Trusts are revocable in nature, which is the legal wording used to also indicate that they are amendable, or can be changed. This is the type of Trust that I prepare for 95% of my clients, as it is almost always necessary that things be changed over time.

This is because our personal and legal lives change with time – we all get older, if we have children they age and their needs grow, our financial situation evolves. If someone prepared what we call an Irrevocable Trust for you in the past, we hope that the preparer had a real good reason to do so!
